Terms & Conditions

1. Scope

These Terms & Conditions apply to all contracts concluded between Casesta and consumers via the VEXDER online store.

Consumer within the meaning of these terms is any natural person acting for purposes that are predominantly outside their trade or profession (§13 BGB).

2. Eligibility & Age Restriction

Our products are intended exclusively for persons aged 18 years or older.

By placing an order, you confirm that you are at least 18 years old. We reserve the right to perform age verification checks.

3. Products

We sell electronic devices and accessories, including:

• VEXDER Smart device
• Empty pod (refillable)
• Lanyard

The pod is delivered empty and does not contain liquid.

Product descriptions are provided to the best of our knowledge. Minor deviations in appearance or functionality may occur.

4. Contract Conclusion

The presentation of products in the online store does not constitute a legally binding offer.

A binding purchase contract is formed when:

• You complete the checkout process, and
• We confirm your order via email.

5. Prices

All prices shown are final prices.

According to §19 UStG, VAT is not charged and therefore not shown (small business regulation).

Shipping costs (if applicable) are displayed separately during checkout.

6. Payment

Payment is due immediately upon order placement.

Available payment methods:

• Credit / Debit Card (Visa, Mastercard, American Express) via Stripe

We reserve the right to modify available payment methods.

7. Shipping & Delivery

Delivery is limited to:

• European Union
• Switzerland

Delivery times and shipping details are provided in our Shipping & Payment page.

8. Retention of Title

The goods remain the property of Casesta until full payment has been received.

9. Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details, conditions, and exclusions are explained in our Withdrawal Policy (Widerrufsbelehrung).

Important notes:

• Used pods are excluded from return
• Items must be returned complete and undamaged

10. Warranty & Liability

Statutory warranty rights apply.

We are liable for damages only in cases of:

• Intent
• Gross negligence
• Injury to life, body, or health

Liability for minor negligence is excluded unless essential contractual obligations are violated.

11. Product Use & Safety

The device is intended for adult use only.

Improper use, modification, or use with incompatible accessories may result in damage and void warranty claims.

No medical or health benefits are claimed.

12. Cancellation

Orders may be cancelled before shipment in accordance with our Cancellation Policy.

Once shipped, orders are subject to the statutory withdrawal process.

13. Data Protection

Personal data is processed in accordance with our Privacy Policy.

14. Governing Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

15. Jurisdiction

If the customer is a consumer, statutory jurisdiction rules apply.

16. Severability Clause

If any provision of these Terms & Conditions is or becomes invalid, the remaining provisions remain unaffected.
